Terms of service for consumers

For using the Praydy app and buying audio versions. As of 26 October 2026. The German version is the legally binding one.

1. Provider and scope

The provider is Verein zur Förderung von selbstbestimmtem Leben, register number (ZVR) 1550846083, Breitwiesergutstraße 44, 4020 Linz, Austria, office@gernbauer.com. These terms apply to consumers within the meaning of the Austrian Consumer Protection Act who use the Praydy app or buy audio versions in it. They do not apply to businesses.

2. Services

Praydy creates personal prayers from original texts of various traditions, shows them with their sources and checks every text with two independent AI models before it is shown. Reading, saving and sharing prayers are free. For a fee we offer audio versions: reading aloud with a personal voice and, once available, a sung Gospel song of two to three minutes, each as an MP3 file to download. The content is produced by artificial intelligence; it does not replace pastoral, medical or legal advice.

3. Account and conclusion of contract

Use requires an account with a confirmed e-mail address (minimum age 14; younger persons only with a guardian's consent). A purchase is concluded when you complete the order with the obligation to pay in the PayPal checkout and we confirm the payment. You receive the order confirmation by e-mail; we do not store the contract text separately, and these terms are available at any time.

4. Prices and payment

The price per audio version is 2 USD including statutory VAT and is shown before purchase. You can buy credit for 1 to 10 audio versions at once. Payment is made through PayPal, with a PayPal account or a credit card in the PayPal checkout; payment data is processed exclusively by PayPal. At checkout you may add a voluntary donation; it is a gift to the association, not consideration, and is shown separately.

5. Right of withdrawal

As a consumer you have a right of withdrawal of 14 days from the conclusion of a distance contract (§ 11 FAGG), which you can exercise informally by e-mail to office@gernbauer.com. Audio versions are digital content not supplied on a physical medium. If, before purchase, you expressly agree that we start production immediately and confirm that you thereby lose your right of withdrawal, the right expires when production begins (§ 18(1)(11) FAGG). Without this consent we start only after the period has ended.

6. Production and delivery

The audio version is produced automatically after payment confirmation and made available in the app for listening and download, usually within a few minutes. If production fails, you can restart it free of charge; if it keeps failing, we refund the purchase price.

7. Usage rights

You receive a simple, perpetual right to use the purchased audio version privately, to store it and to share it within your private circle. Commercial use, resale or publication on streaming platforms are not permitted. Texts from source libraries remain subject to the terms of the respective source, which is linked in the app.

8. Warranty

The Austrian Consumer Warranty Act applies to digital services. If an audio version does not match the agreed quality, for example because it is incomplete or cannot be played, you are entitled to a remedy and, if that fails, to a price reduction or termination of the contract. The artistic design of a song (melody, voice, arrangement) is not a defect.

9. Liability

We are liable without limitation for intent and gross negligence, and for slight negligence only for personal injury. Prayer texts are created with care and double checking; we give no guarantee of fitness for a particular purpose. Availability of the app may be limited by maintenance or outages of service providers.

10. Donations

Donations to the association are voluntary, not tied to any consideration and are not refunded. Whether a donation is tax-deductible depends on the association's status and will be announced separately.

11. Term and termination

The account is open-ended and can be deleted by you in the app at any time. We may block an account after a warning in case of serious violations, in particular abusive use or attacks on the service. Audio versions already purchased remain available for download for 30 days after termination.

12. Applicable law and dispute resolution

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory protective provisions of the state in which you have your habitual residence as a consumer remain unaffected. EU platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in proceedings before a consumer arbitration board.
